In this Petition, petitioners have sought for appointment of Arbitrator as per Clause 26 of the Limited Liability Partnership Agreement of "M/s.Nostromo Developers LLP", dated 08.02.2021, as per Annexure-A to the Petition. 2. Heard Sri. K.G. Raghavan, learned Senior Counsel appearing on behalf of Sri. Badri Vishal, learned counsel for the petitioners, Sri. D.R. Ravishankar, learned Senior Counsel appearing on behalf of Sri. Bhargav K.S., learned counsel for the respondent No.1, Sri. R.V.S. Naik, learned Senior Counsel appearing on behalf of Smt. Having taken note of the submissions made by the learned Senior Counsel appearing for the parties and the averments made in the petition and further taking into consideration that the disputes relating to business between the parties has to be decided by an Arbitrator to be appointed in terms of Clause 26 of Annexure-A, under the provisions of the Arbitration and Conciliation Act, 1996, I am of the opinion that, appointment of an Arbitrator is necessitated. Accordingly, Hon'ble Justice Shri. A.S. Bopanna, former Judge of the Hon'ble Supreme Court, is hereby appointed as an Arbitrator to resolve the dispute between the parties. 4. The Registry is directed to communicate this order to the Arbitration and Conciliation Centre, Bengaluru and also to Hon'ble Justice Shri. A.S. Bopanna, former Judge of the Hon'ble Supreme Court, forthwith. 5. Having heard the learned counsel appearing for the parties on *I.A.2/2025 filed by respondent No.1 herein, with regard to impleading the proposed respondent No.4 - HDFC Bank, it is open for the parties to implead proposed respondent No.4 before the hon'ble Arbitrator, under the circumstances of * corrected vide Chambers order dated 06.04.2026 - 5 - HC-KAR NC: 2026:KHC:17307 CMP No. 630 of 2025 the case, if so advised, and at the disposal of the Hon'ble Arbitrator. 6. Accordingly, this Civil Miscellaneous Petition stands disposed of. 7. All contentions of the parties including with regard to arbitrability of the dispute between the parties, are kept open.
