This Writ Petition under Article 226 of the Constitution of India has been filed for the followings reliefs:- "(i) That, this Hon'ble Court may issue appropriate writ quashing the impugned order dated 10.03.2026 (Annexure-P/1) passed by the Respondent No.3, the Chief Executive Officer Zila Panchayat, Balodabazar-Bhantapara (CG) and the impugned order dated 11.03.2026 (Annexure-P/2) passed by the respondent No.4 Chief Executive Officer Janpad Panchayat Simga, District Balodabazar- Bhantapara (CG). (ii) That, this Hon'ble Court may issue appropriate writ directing the respondents to maintained the status quo regarding the posting of the Panchayat Secretary at Gram Panchayat, Hathband. (iii) Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interest of justice." 2. Learned counsel for the petitioner submits that the Respondents Authorities within 11 months have transferred three Panchayat Secretary of Gram Panchayat Hathband without any cogent reasons, due to which, welfare scheme of Gram Panchayat got hampered. He further submits that presently Vinod Das Vaishnav is working as Panchayat Secretary who was posted on 03.06.2025, but he has also been transferred vide order dated 10.03.2026 (Annexure-P/1). Thereafter, again transfer order has been passed on 11.03.2026 (Annexure-P/2). Hence, such continuous transfer orders without any basis are not justifiable and the same are affecting the welfare schemes in Gram Panchayat. 3 3. In reply, learned counsel for respondent No.4 would submit that Vinod Das Vaishnav was not posted as Panchayat Secretary of Village Panchayat Hathband, rather he was granted additional charge of Village Panchayat Hatband. Further, now vide order dated 10.03.2026 (Annexure-P/1) Heeralal Yadav has been posted as Secretary of Village Panchayat Hathband. He also submits that Vinod Das Vaishnav was transferred on account of complaint made by various villagers. 4. Heard learned counsel for the parties and perused the documents placed with the writ petition. 5. Having considered the fact that Vinod Das Vaishnav has been transferred on account of complaints made by villagers and in his place Heerlal Yadav has been posted as Panchayat Secretary of Village Panchayat Hathband vide impugned order dated 10.03.2026 (Annexure-P/1), at this stage, this Court is not inclined to interfere with the order dated 10.03.2026 (Annexure-P/1) and subsequent order dated 11.03.2026 (Annexure-P/2). 6. However, it is observed that the transfer of a Village Panchayat Secretary should not be carried out frequently without justifiable reason, ensuring that the execution of welfare schemes in the concerned Village Panchayat is not hampered. 7.
