The petitioner is apprehending his arrest in connection with Chatra Sadar P.S. Case No. 144 of 2011. It has been alleged that in the financial year 2009-10 and 2010-11, the Agriculture and Sugarcane Development Department, Ranchi had supplied seeds of various plants to the Block Agriculture Officer, but despite repeated reminders, the agriculture contribution was not deposited by the petitioner. Submission has been advanced by the learned counsel for the petitioner that the petitioner is aged more than 70 years. It has been submitted that even after all these years, charge sheet has not been submitted. It has also been submitted that so far as the petitioner is concerned, he was posted as a Block Agriculture Officer at the relevant point of time and the defalcation amount is to the tune of Rs. 54081/-. Learned Spl.P.P. has opposed the prayer for anticipatory bail of the petitioner. Regard being had to the age of the petitioner and the amount in question, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned CJM, Chatra in connection with Chatra Sadar P.S. Case No. 2026:JHHC:16023 144 of 2011, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed.
