1. Applicant seeks regular bail in case FIR No.250/2024 dated 22.03.2024, registered at Police Station Nangloi, for commission of offences under Sections 302/34 IPC. 2. There are five accused persons in all, who are facing the abovesaid murder trial. These are Chanda, her brother-Suraj, her brother’s friend Manoj and other two accused are Vishal and Rahul Gujjar (applicant herein). As per prosecution case, FIR in question was registered on the basis of the statement made by daughter of the deceased, who is eye-witness of murder. 3. The alleged incident is of 21.03.2024, when some altercation took place between accused Chanda and deceased. to the house of deceased and started quarreling with him. In the meanwhile, accused Vishal and his friend Rahul also arrived at the spot. Vishal is stated to be friend of accused Chanda and as per the case of prosecution, it was at the instigation of Chanda that he, too, had come there. As per the specific case of prosecution, Vishal caught hold of her father and stabbed him with a knife. 4. Charges have already been ascertained and the case is at the stage of trial. Nine PWs have already been examined. 5. Said daughter of the deceased has already been examined as PW-1 and though in her deposition, she has fully supported the case of prosecution, fact remains that no specific role, as such, has been ascribed to the applicant herein. In her deposition, she claimed that when she along with her father and younger sister were inside their home, someone banged the door and when her father opened the door, brothers of Chanda, came inside and started arguing with her father. Her father tried to calm them down, upon which they started abusing him. She further deposed that in the meanwhile, accused Vishal and one another boy came there and accused Vishal caught hold of her father and took out a knife and stabbed her father.
Thereafter, all the accused persons ran away from there. One another material witness i.e. PW2 Varsha has though been examined, she has not supported the case of prosecution as she failed to identify the accused persons. 6. Fact remains that the material public witnesses have already been examined and the entire case of prosecution is, primarily, dependent upon the testimony of PW-1 Vanshika, who, as already noticed above, has not elaborated about any specific role to the present applicant, in particular. 7. Admittedly, the incident got triggered on the basis of instigation by Chanda. Though, Chanda did not enter inside the house of the deceased, she This is a digitally signed order. has been alleged to be part of conspiracy. Admittedly, she has already been enlarged on bail by this Court as would be evident from order dated 07.11.2025 passed in BAIL APPLN.3654/2025. There is nothing to indicate that there was any direct instigation by Chanda to the applicant herein. 8. Nominal Roll of the applicant has been requisitioned from the Jail Authorities. He is, reportedly, 25 years of age and has undergone incarceration for more than 2 years. He has no prior antecedents and his jail conduct is recorded as satisfactory. The affidavit of mother of the applicant is also on record, which does not disclose any other case of the applicant herein. Learned Addl. P.P. for the State, on instructions from the Investigating Officer, submits that to the best of their information also, the applicant is not involved in any other case. 9. Keeping in mind the overall facts of the case and in particular, the period of incarceration of applicant, his young age and the fact that the material public witnesses have already been examined, albeit, without expressing any opinion over the merits of the case, the applicant is, hereby,
directed to be released on bail on his furnishing personal bond in a sum of Rs.25,000/- with two sureties of like amount, subject to satisfaction of learned Trial Court/CMM/Duty Magistrate on the same conditions as mentioned in
order dated 07.11.2025 passed by this Court in BAIL APPLN.3654/2025.
10. The application stands disposed of in aforesaid terms.
11. A copy of this order be sent to the learned Trial Court and also to the Jail Superintendent for necessary information and compliance.
