3. Perused the FIR as at Annexure-1. The details of the alleged incident are narrated therein. It is alleged in the FIR that the father of petitioner No.1 and others committed the overt acts and slapped the PEO of the GP, who was assigned to look after the tender process, hence, the report was lodged. Mr. Mohapatra, learned counsel for the petitioners submits that petitioner No.1 has been arrested and released on bail in the meantime, whereas, petitioner No.2’s name is not revealed in the FIR. It is also claimed that the principal accused, namely, p. 2 Sarat Kumar Mohapatra, who is the father of petitioner No.1 is also on bail. On being asked, it is informed that petitioner No.2 does not have any other antecedent. Recorded the objection of Mr. Panda, learned ASC for the State. Since the other two accused persons related as father and son are on bail, this Court is inclined to direct petitioner No.2 to surrender before the learned court below to go on bail with conditions though not inclined to entertain his bail plea.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, petitioner No.2 surrenders before the court of learned J.M.F.C., Baramba within fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.188 of 2026 corresponding to Baramba P.S. Case No.130 of 2026 on furnishing a bail bond of Rs.15,000/-(rupees fifteen thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case. The bail plea vis-à-vis petitioner No.1 stands dismissed for being infructuous as he was arrested and has been released on bail in the meantime.
