1. Heard Sri Prem Prekash Yadav, learned counsel for the petitioner, Ms. Uttara Bahuguna, learned Additional Chief Standing Counsel for State- respondents and Sri Sunil Kumar Singh, learned counsel representing Gaon Sabha - respondent no. 8.
2. In view of the order we propose to pass, no notice is required to be sent to the private respondent Nos.5 to 7.
3. The instant writ petition has been preferred praying inter alia for the following relief -:
"I. A writ, order or direction, in the nature of Mandamus commanding and directing the Special Land Acquisition Officer/D.M. not disburse the Land Acquisition to compensation of acquired in respect portion of gata no.460 to any person other than petitioner, until the final disposal. of Writ-B No.27 of 2026. II. A writ, order or direction, in the nature of Mandamus and directing to respondent no.2 i.e. Special Land Acquisition Officer/ District Magistrate, Bulandshahr to decide the representation dated 30.3.2026 (Annexure No 4 to this writ petition) filed by the petitioner."
4. Learned counsel for the petitioner in support of his submission, has Versus Counsel for Petitioner(s) : Alok Singh Yadav, Prem Prakash Yadav Counsel for Respondent(s) : C.S.C., Sunil Kumar Singh Vikram Singh .....Petitioner(s) State Of U.P. And 7 Others .....Respondent(s)
placed reliance on the interim order passed by the learned Single Judge in Writ B No. 27 of 2026, Vikram Singh vs. State of U.P. and 8 others, wherein the petitioner claimed certain rights and learned Single Judge entertained the aforesaid writ petition and effect and operation of the
order dated 15.09.2025 passed by the Additional Commissioner (Administration), Meerut Division, Meerut and order dated 13.10.2025 passed by respondent no. 2, Board of Revenue, Meerut Division had been stayed. Learned counsel next submits that on one hand, the proceedings are going on before learned Single Judge and on the other hand, there is every apprehension that the compensation shall be released in favour of the private respondents arrayed as respondent nos. 5 to 7. Learned counsel for the petitioner, in this backdrop, submits that a direction be issued to the Special Land Acquisition Officer/District Magistrate, Bulandshahr to decide the application/representation dated 30.03.2026.
5. Considering the facts and circumstances and the relief as prayed for, we are not inclined to advert on the merit of the case. However, in case any such application is pending consideration, the same shall be decided by the concerned Special Land Acquisition Officer within a period of six weeks from the date of production of certified copy of this order but certainly after giving ample opportunity of hearing to all the stakeholders arrayed as respondent nos. 5 to 7. It is also made clear that while deciding the aforesaid application, the observations made by this Court would not prejudice the rights of the parties.
6. With the aforesaid observations, the instant writ petition stands
disposed of.
