Heard Sri Ashish Kumar Singh, learned Senior Advocate assisted by Sri Atul Kumar Shahi, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order of suspension/ notice issued to him dated 13.08.2026 suspending the contract of the petitioner on letters submitted by fair price shop dealers that they had received lesser food to what that was prescribed. Learned counsel for the petitioner submits that that action suspending the contract without any prior notice is per se bad, inasmuch as, there was no preliminary fact finding enquiry was held. However, petitioner submits that he has submitted reply to the notice. In the circumstances, since the petitioner submitted that he has submitted reply to the notice, we dispose of this petition with direction to the authority concerned namely Versus Counsel for Petitioner(s) : Anshul Sengar, Atul Kumar Shahi Counsel for Respondent(s) : C.S.C. M/S Pc Transport .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) the Regional Food Controller, Basti Region, Basti to take final decision in the matter of show cause dated 13.08.2026 within a period of two months from today after giving full opportunity of hearing to the petitioner. In the meanwhile the order of suspension dated 13.08.2026 shall remain stayed. However, this order of stay shall abide by the final outcome of the decision to be taken by the authority as directed herein above.
