WP No. 7904 of 2026 For Petitioner : Mr.T.S.Rajamohan For Respondent: Mr.Stalin Abhimanyu, Additional Government Pleader ORDER This writ petition has been filed, challenging the paper publication made in Dinakaran Tamil Newspaper dated 28.06.2025 issuing notice under Section 15(2) of the Tamil Nadu Highways Act, 2001, pertaining to the property, morefully disclosed in the prayer to this writ petition. 2.According to the petitioner, she is the absolute owner of the property, morefully disclosed in the prayer to this writ petition through a registered Settlement Deed executed in her favour. According to the petitioner, under the impugned paper publication dated 28.06.2025, her name is not reflected. The corresponding serial number, pertaining to the petitioner’s property is Sl.No.8. Sl.No.8 reflects the name of the predecessor of the title of the property and not the name of the petitioner. The petitioner had given a representation to the respondent on 20.01.2026 calling upon them to issue all notices as per the provisions of the Tamil Nadu Highways Act, 2001 only to her since she is the owner of the property. WP No. 7904 of 2026 3.Mr.Stalin Abhimanyu, learned Additional Government Pleader accepts notice on behalf of the respondent.
He would submit on instructions that only based on the revenue records, the impugned paper publication was effected as per the provisions of Section 15(2) of the Tamil Nadu Highways Act, 2001. He would also submit that in case the petitioner is the owner of the property, the petitioner will have to produce supporting documents to substantiate the same before the respondent to enable the respondent to issue a fresh notice to the petitioner under Section 15(2) of the Tamil Nadu Highways Act, 2001. 4.No prejudice would be caused to the respondent if a direction is issued to the respondent to pass final orders, on merits and in accordance with law on the petitioner’s representation dated 20.01.2026, within a time frame to be fixed by this Court and in the event the petitioner is found to be the owner of the property, the respondent will have to issue fresh notice to the petitioner as per the provisions of Section 15(2) of the Tamil Nadu Highways Act, 2001 to enable the petitioner to proceed further. 5.This Court is not expressing any opinion on the merits of the petitioner’s representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the respondent to pass final orders, on merits and in accordance with law on the https://www.mhc.tn.gov.in/judis
WP No. 7904 of 2026 petitioner’s representation dated 20.01.2026 seeking for recognising her as the owner of the property, based on the supporting documents, produced by her, which includes the Settlement Deed obtained by her for the said property, within a period of 12 weeks from the date of receipt of a copy of this order and in case the respondent comes to the conclusion that the petitioner is the owner of the property, the respondent will have to issue fresh notice as per the provisions of Section 15(2) of the Tamil Nadu Highways Act, 2001 to the petitioner to enable her to proceed further with regard to the said notice in the manner known to her under law.
