1. Allowed, subject to all just exceptions. 2. Accordingly, the present application stands disposed of. FAO(OS) 82/2026
3. The present appeal has been filed seeking the following reliefs:
“a. Summon the trial court record of CS (OS) No. 324/2026 titled as
“Narinderjeet Kaur & Others Vs. Inder Pal Singh Bhatia & Others;” and/or b. Set aside the Impugned Order dated 08.07.2026 passed in IA No. 13324/2026 in CS(OS) 324/2026 titled as “Narinderjeet Kaur & Others Vs. Inder Pal Singh Bhatia & Others;”; and /or c. Allow IA No. 13324/2026 filed in CS (OS) No. 324/2026 titled as
“Narinderjeet Kaur & Others Vs. Inder Pal Singh Bhatia & Others” to the extent of directing the Respondents to maintain status quo as to title and possession and structure qua the Suit Property bearing No. J-8/66, Rajouri Garden, New Delhi – 110027 till final disposal of the CS (OS) No. 324/2026;” This is a digitally signed order. 4. We have heard learned counsel for the parties. 5. With the consent of both the parties, the following order is being passed. 6. The defendant-respondent shall be at liberty to raise constructions as they so desire. However, any such construction raised would be at their own costs and risks and would not create any equitable rights in their favour. The final judgment in the suit shall cover all the aspects with regard to rights of the parties and their share in the property. The parties shall not create any third party rights. 7. At this stage, learned counsel for the parties submit that the interim injunction application is still pending in the CS(OS) 324/2026 before the learned Single Judge.
In view of the aforesaid, the interim injunction application pending before the learned Single Judge stands disposed of by this consent order. 8. The impugned order of learned Single Judge dated 08.07.2026 in I.A. 13324/2026 in CS(OS) 324/2026 stands substituted by this consent order. 9. We have not considered or decided upon the title of the property, all questions relating thereto are left open for consideration in accordance with law. 10. Accordingly, the present appeal stands disposed of in the aforesaid terms. Pending application(s), if any, also stand(s) disposed of.
