1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to a writ in the nature of mandamus quashing the impugned transfer order dated 04.06.2025 (Annexure P/1), the rejection order dated 23.09.2025 (Annexure P/2) and the relieving order dated 16.10.2025 (Annexure P/2). 10.2 That, the Hon’ble Court may kindly be pleased to direct the respondents to reinstate the petitioner at Government Primary School, Silphili, with all consequential benefits, including continuity of service. 10.3 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to verify and correct the enrollment records of Government Primary School, Silphili and reconsider the rationalization process in accordance with the guidelines dated 02.08.024 and 09.07.2024 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit and appropriate.”

Learned counsel for the petitioner submits that the petitioner is holding the post of Assistant Teacher and he was transferred from Government Primary School, Siphili, Block - Shankargarh to Government Primary School, Surugpan, Block – Ramchandrapur on the ground that the petitioner is in excess. Against the order of transfer, petitioner had submitted a representation dated 19.06.2025 (Annexure P/6) before the Divisional Level Committee constituted under the Rationalization Scheme, however, the representation was rejected vide order dated 23.09.2025.
Learned counsel for the petitioner also submits that in the earlier place of posting, i.e. Government Primary School, Silphili, Block – Shankargarh, there were 81 students and the school in which, petitioner is transferred is having only 60 students and therefore, transfer of the petitioner is bad.
3. On the other hand, learned counsel for the Respondent/State submits that there is no merit in this writ petition. According to the submission of
3 counsel for the parties, there were 80 students and further, as submitted by counsel for petitioner, 03 Teachers were posted and still 03 Teachers are working. According to the policy, for 30 students, there should be 01 Teacher and posting of the petitioner is according to the policy of the State Government. No other exceptional ground is raised in this writ petition.
4. I have heard learned counsel for the parties and perused the documents enclosed along with the writ petition.

Perusal of the order/decision taken by the Committee constituted under the Transfer Policy, 2025 would show that the Committee has considered that in school with children upto 90 in strength, there shall be 01 Headmaster and 02 Assistant Teachers and the rest of the Teachers will be declared in surplus and further taking note of the directive under the circular/guidelines that the Teacher who are under probation are not to be declared in surplus have passed the order. Learned counsel for the petitioner could not able to point out any error in decision of by the Committee while passing the impugned order dated 23.09.2025 (Annexure P/2) and therefore, I do not find any good ground to interfere with the impugned order dated 23.09.2025 (Annexure P/2) passed by the Divisional Level Committee.
