ORAL ORDER On oral request of the learned counsel for the petitioner, petitioner is permitted to implead the father of the victim, as a respondent, who is also present before the Court.
2. This petition is by the accused in Crime No.39/2026 charged for offences punishable under Sections 9 and 10 of the Prohibition of Child Marriage Act.

Learned counsel for petitioner submits that a complaint came to be filed by Co-ordinator of Child Help Line, Mandya before the respondent police, alleging that she had received the information by certain Padmananda of Mysore, alleging marriage between the accused-petitioner herein with victim who is stated to be aged about 17 years. Based on

which, the respondent police have registered the case under Sections 9 and 10 of the Prohibition of Child Marriage Act, which prohibits marriage of a child below 18 years. Learned counsel for petitioner further submits that accused-petitioner is son of the sister of respondent No.2, who is the father of the victim. Respondent No.2 is personally present before this Court admits to the fact that accused-petitioner is the son of his sister and he has no objection for allowing the bail petition.
4. Learned HCGP submits though it is a marriage in violation of Sections 9 and 10 of the Act, the fact that the victim is below age 18 years would attract the offence punishable under Section 8.
5. Heard and perused the records.
6. Admittedly, accused-petitioner is the nephew of respondent No.2 whose marriage has been solemnized with the daughter of respondent No.2. In the complaint given by Co-oridnator of Child Help Line, Mandya, it is alleged that the age of the victim is below 18 years at the time of marriage. This requires to be proved during trial. Considering the facts

narrated above and in the light of respondent No.2 indicating no objection for allowing the petition, this Court deems it appropriate to grant bail as sought for. Accordingly following:
ORDER Petitioner is directed to be enlarged on bail in the event of his arrest in Crime No.39/2026 registered by Halagur Police Station, Mandya, for the offences punishable under Sections 9 and 10 of the Prohibition of Child Marriage Act, subject to following conditions:
1. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/-(One lakh only) with one local surety for the likesum to the satisfaction of the trial Court.
2. Petitioner shall appear before the Investigation Officer within 10 days from the date of receipt of certified copy of this order and extend full co-operation in the investigation of the matter.
3. Petitioner shall appear before the trial Court and obtain regular bail within 15 days from the date of receipt of certified copy of this order.
4. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

5. Petitioner shall not tamper with the prosecution witness.
