Mr. Ayaskanta Ghosh Mr. Partha Ghosh Mr. Tias Mitra … for the petitioner Ms. Parna Roychowdhury Ms. Payel Ghosh Ms. Trisha Chanda … for the Bank The grievance of the petitioner is directed against an e-auction sale notice dated 17th January, 2026 which has been conducted under the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI). There is an incidental prayer for refund of the entire sum paid by the petitioner along with interest. On behalf of respondent-Bank, it is submitted that the petitioner has a statutory alternative efficacious remedy under Section 17 of SARFAESI. In view of the nature of disputes raised by the petitioner and the challenge to the e-auction notice issued under Section 13(4) of the 2 SARFAESI, there is no ground whatsoever as to why this Court should entertain this writ petition. WPA 5478 of 2026 stands dismissed. Liberty is granted to the petitioner to avail of the statutory alternative remedy in accordance with law, if so advised. It is made clear that there is no expression on the merits of the case and all issues are left open for the appropriate authority to be decided strictly in accordance with law.
