That, this Hon'ble Court may kindly be pleased to call the entire records of the case, from the respondents offices, relating the Petitioner case. 10.2. That this Hon'ble Court be kindly be pleased quashed and thereby set aside the findings and Order bearing No. Kra./6613/Vachak/2015, Jashpur, dtd.30.11.2015, passed by the Respondent No.02, i.e. REKHA SINGH -2- Collector Jashpur, and there upon the Order/Notice bearing No. Kramank/124/Vachak/2016 Kunkuri dtd. 22.01.2016, issued and get Chaspa in in the late evening hours of 17.30 PM, on dtd. 23.01.2016 at the premises of the Petitioner's Ashram, issued by the Sub-Divisional Officer (Revenue) Kunkuri, District Jashpur, subjecting to get cancealled the order of the diversion granted in the proposed land of the Petitioner, with its all ancilliary effects. 10.3. That this Hon'ble Court be kindly be pleased to direct the Respondents by granting protections to the Respondent No.3, from the Respondent No.2 or other superior authorities, in the form that the while seeking or not the permission for Reviewing his own order, the SDO(Revenue) Jashpur be not subjected to be influenced, and decide the same under his own judicial minds, and further be also directed to decide the diversion case of the Petitioner in the light of the prescribed legal manner, in the earliest manner. 10.4 That, this Hon'ble Court be kindly be pleased to restrained the Respondents,to not take any coercive action against the Petitioner, in the so far as its relates with the granting of the diversion order in the proposed land of the Petitioner, on the basis of the Order Impugned, till the final adjudication of the instant Petition. 10.5 That any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may also be granted in the favour of the Petitioner and against the Respondents. 10.6 That This Hon'ble Court be pleased to quashed Order dtd. 2016 23.01.2016 passed by SDO(Revenue) Kunkuri District Jashpur in case No. 04/A-2/2014-15, thereby their earlier order dtd. 22.07.2015 of granting Diversion in the Revenue Case No. 04/A-2/2014-15, in the Respect of the proposed area of land, had been rejected, with its all ancilliary effects.” 2. In this petition, the petitioner has challenged the order dated 30.11.2015 (Annexure P/1). 3. Ms. Saumya Sharma, learned Panel Lawyer appearing for the 3 State would submit that against the order dated 30.11.2015, Revision No.201601960100006/37/A-2/2015-2016 was preferred by the petitioner before the Commissioner and same has been dismissed by the learned Commissioner, Surguja Division, Ambikapur vide order dated 03.05.2024. 4. The petitioner failed to disclose the fact that revision was preferred against order dated 30.11.2015 and it has been dismissed. 5. As the revision preferred by the petitioner has already been dismissed by the Commissioner vide order dated 03.05.2024 and the petitioner has not assailed the said order, in my opinion, this petition is not maintainable and is hereby dismissed. However, the petitioner would be at liberty to avail remedy available under the law. 6.
