2026:JHHC:15993 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A No. 2849 of 2026 Anwar Miyan … … Petitioner Versus The State of Jharkhand ... Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY ------- For the Petitioner : Mr. Ashish Kumar, Advocate For the Opp. Party : A.P.P ------- 02/02.06.2026 Heard Mr. Ashish Kumar, learned counsel for the petitioner and learned A.P.P. The petitioner apprehends his arrest in connection with Basantrai P.S. Case No.22 of 2025. It has been alleged that the daughter of the informant was enticed away by the accused persons. Submission has been advanced by learned counsel for the petitioner that in the trial of the son of the petitioner the victim has been examined as P.W.6 who has categorically stated that she was having love affair with the son of the petitioner for the last three years and she wants to solemnize marriage with him. It has been submitted that the petitioner has been implicated only on account of the fact that he is the father of the main accused Md. Kaisar. Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner. Regard being had to the evidence of the victim who has been examined as P.W.6 which dilutes the role played by the petitioner and enhances the fact that there was a love affair between the son of the petitioner and the victim, I am inclined to extend the privilege of anticipatory bail to him. Accordingly, he is directed to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten 2 Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1st cum Special Judge (POCSO), Godda in connection with Basantrai P.S. Case No.22 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. This application stands allowed. (Rongon Mukhopadhyay, J.)
