For the Opp. Party : Spl.P.P ------- 02/02.06.2026 Heard Mr. Mritunjay Kr. Choudhary, learned counsel for the petitioners and learned Spl.P.P. The petitioners apprehend their arrest in connection with Bero P.S. Case No.97 of 2023. It has been alleged that the petitioners and several Jal Sahiyas had illegally withdrawn various amounts by forging the signature of the informant. It has been submitted by learned counsel for the petitioners that both the petitioners are Jal Sahiyas and the total amount they had withdrawn, was to the tune of Rs.3,50,000/-. It has further been submitted that one of the co-accused similarly situated namely Sushanti Orain has been granted anticipatory bail in A.B.A. No.1782 of 2026. Learned counsel adds that an amount of Rs. 1,39,000/- had already been returned back to the Department. Learned Spl.P.P has opposed the prayer for anticipatory bail of the petitioners. It appears that so far as the petitioner no.1 is concerned, an amount of Rs. 3,09,000/- was withdrawn and so far as the petitioner no.2 is concerned, an amount of Rs. 41,000/- has been withdrawn. Learned counsel for the petitioners have failed to state the break-up of the amount of Rs.1,39,000/- which has already been deposited in the bank account. So far as the case of 2 Sushanti Orain, who has been granted anticipatory bail, is concerned, it seems that the entire amount of Rs.39,000/- withdrawn by her fraudulently, had been returned back. However, the case of the present petitioners therefore is easily distinguishable from the case of the co-accused who has been granted anticipatory bail.
