The present application has been filed for seeking condonation of the delay in filing the appeal. It has been asserted that the applicant was having difficulty in engaging the counsel and to arrange the funds. He applied for legal aid counsel, which was granted to him on 09.06.2026 and thereafter the legal aid counsel had obtained the complete record of the case, hence, the delay in filing the appeal. Therefore, it was prayed that the present application be allowed and the delay of 56 days in filing the appeal be condoned.
Learned Additional Advocate General submits that he does not want to file any reply.
A perusal of the record shows that the applicant is being represented by the legal aid counsel and is presently lodged in judicial custody at Nahan, therefore, the plea taken by him that he was unable to engage the counsel due to paucity of funds is duly explained. Since a person cannot be deprived of his
right to pursue his case due to paucity of funds and further some time is consumed in the processing of an application for legal aid. Accordingly, the delay of 56 days in filing the appeal is condoned.
The application stands disposed of.
