By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS'), the petitioners seek quashing of FIR No. 079/2021 dated 20.03.2021, registered at Police Station Tigri, District South, Delhi, for the offences punishable under Sections 363/366/366A/376/471/120B of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), Sections 6/17/21 of the Protection of Children from Sexual Offences Act, 2012 (hereinafter referred to as the ‘POCSO Act’), and Sections 9/10/11 of the Prohibition of Child Marriage Act, along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties. 4. Learned APP accepts notice on behalf of the State.
5. Petitioner no.1 and Respondent No. 2 are present before this Court and have been duly identified by their counsels and Investigating Officer concerned.
6. Briefly stated, the present FIR came to be registered on the complaint of Respondent No.2 alleging the commission of offences under the aforesaid provisions. During the pendency of the proceedings, Petitioner No.1 and Respondent No.2 solemnised their marriage on 05.05.2021. Out of the said wedlock, two daughters were born on 26.10.2021 and 10.06.2024. The parties are presently residing together as husband and wife and have amicably resolved all their disputes. Respondent No.2 has also placed on record her affidavit expressing no objection to the quashing of the present FIR.

Learned counsel for the petitioners submits that the parties have amicably resolved all their disputes and have been residing together peacefully as husband and wife along with their two minor children. It is submitted that nothing further survives for adjudication between the parties.

On a query put by this Court, Respondent No.2, who has been duly identified by the Investigating Officer, categorically states that she has entered into the settlement of her own free will, without any force, coercion or undue influence. She further states that she is residing peacefully with Petitioner No.1 along with their children and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed.

Having regard to the facts and circumstances of the present case, particularly the fact that the parties have solemnised their marriage, have been residing together for the last several years, are blessed with two children, and This is a digitally signed order. have voluntarily resolved all their disputes, this Court is of the opinion that continuation of the criminal proceedings would serve no useful purpose and would only disturb the settled matrimonial life of the parties. There is no legal impediment in quashing the proceedings in the peculiar facts of the present case.

Accordingly, FIR No. 079/2021, registered at Police Station Tigri, District South, Delhi, for the offences punishable under Sections 363/366/366A/376/471/120B IPC, Sections 6/17/21 of the POCSO Act and Sections 9/10/11 of the Prohibition of Child Marriage Act, along with all consequential proceedings arising therefrom, is hereby quashed.
11. The present petition stands disposed of. Pending application(s), if any, stands disposed of.
