HON'BLE MR. JUSTICE GANESH RAM MEENA Order 19/01/2026 1. Petitioner has filed this bail application under Section 483 B.N.S.S., arising out of F.I.R. No.171/2025 registered with the Police Station Dangipura, District Jhalawar for offence under Sections 126(2). 115(2), 125 & 3(5) of B.N.S., 2023. 2. Learned counsel for the accused-petitioner submits that because of some dispute in between the accused party and the complainant party, the alleged incident took place all of a sudden and there was stone pelting in between both the parties. He further submits that due to that stone pelting, complainant party has sustained certain injuries. He further submits that so as to make a case of serious and grave nature, the allegation of inflicting injuries by wooden stick has been levelled against the present petitioner. He further submits that if there would have been any such intention of accused-petitioner of causing any such [2026:RJ-JP:2077] (2 of 3) [CRLMB-755/2026] injury, which may lead to death, then he could have used deadly weapon. He further submits that co-accused, Suresh, has already been enlarged on bail by this Court vide order dated 07.01.2026 (S.B. Criminal Misc. Bail Application No.16095/2025). He also submits that the accused-petitioner is in custody since 03.10.2025 and Police after completion of investigation, has submitted charge- sheet in the matter. He also submits that trial of the case is likely to take considerable time to conclude, therefore, the accused- petitioner may be enlarged on bail. 3. Learned Public Prosecutor has vehemently opposed the bail application and submits that one of the injuries sustained by injured, Phoolchand, has been opined to be dangerous to life and same has been attributed to the present accused-petitioner. 4. Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor and also perused the challan papers. 5. On going through the challan papers, it is revealed that the injured, Phoolchand, has sustained two injuries by blunt weapon, out of which one injury has been opined to be simple in nature and the other one has been opined to be grievous in nature, which later on opined to be dangerous to life. The allegation against the present accused-petitioner is of causing injury by wooden stick. Normally in villages, people carry wooden stick (lathi) for their regular use. 6. Taking into consideration the overall facts and circumstances of the case as observed above and more [2026:RJ-JP:2077] (3 of 3) [CRLMB-755/2026] particularly the fact that the co-accused, Suresh, has already been enlarged on bail by this Court vide order dated 07.01.2026 (S.B. Criminal Misc. Bail Application No.16095/2025) and the Police after completion of investigation, has submitted charge-sheet in the matter and so also the fact that the accused-petitioner is in custody since 03.10.2025, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail. 7. This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.
