Ramesh Chand Sharma S/o Ramkaran Sharma, Aged About 56 Years, R/o Achalpura Ki Jheel, Teh Sikray, District Dausa, Hall Resident A-19 Ayodha Nagar, Gandhi Path, Jaipur (Presently In Judicial Custody In Jail At Jaipur). ----Petitioners Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. G.L. Sharma with Mr. Shankar Lal For Respondent(s) : Mr. Vivek Sharma, PP with Mr. Gaurav Gupta, Asst.G.A. Mr. Mohit Sharma HON'BLE MR. JUSTICE SANDEEP TANEJA Order 04/02/2026 1. The present bail application has been filed by the accused- petitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.98/2023 registered at Police Station Karni Vihar, District Jaipur, for the offence(s) punishable under Section(s) 379, 420, 406, 467, 468, 471 & 120B I.P.C. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and have nothing to do with the alleged offences. Learned counsel further submits that in respect of the dispute, the complainant has already filed a civil suit, which is pending consideration before the Court of learned Additional District & Sessions Judge, No.4, Jaipur [2026:RJ-JP:5146] (2 of 3) [CRLMB-607/2026] Metropolitan-II, Jaipur. Learned counsel also submits that the Investigating Agency has filed charge-sheet in the matter, thus, no fruitful purpose would be served by keeping the petitioners in custody. Learned counsel further submits that the case is exclusively triable by a Court of Magistrate and the petitioners have already remained in custody for a long time, therefore, prays that the petitioners may be given the benefit of bail under Section 483 B.N.S.S. 3. Learned Public Prosecutor as well as learned counsel for the complainant oppose the submissions made by learned counsel for the petitioners hereinabove. 4. Heard learned counsel for the parties and perused the material available on record. 5. Taking into consideration the overall facts & circumstances of the case; considering the arguments advanced by learned counsel for both the parties, the fact that charge-sheet has been filed and a civil suit, filed by the complainant, is already pending as well as the trial is likely to take considerable time in its conclusion, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on regular bail. 6. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioners, namely Kusumlata W/o Ramesh Chand Sharma and Ramesh Chand Sharma S/o Ramkaran Sharma, are ordered to be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the [2026:RJ-JP:5146] (3 of 3) [CRLMB-607/2026] Trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when they are called upon to do so.
