Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 20.05.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioners in connection with G.R. Case No.99 of 2026 arising out of Dhama P.S. Case No.19 dated 31st January, 2026 pending in the file of learned J.M.F.C.-II, Sambalpur on the grounds stated. 3. Perused the FIR as at Annexure-1. In the FIR, it is alleged that the petitioners and others confined the employees of a company during the alleged incident. The manner, in which, the overt act has been committed by the accused persons stands narrated therein. A case under Section 109(1) BNS is registered with other allied offences but it is submitted that no one received any grievous injury. Mr. Panda, learned ASC for the State submits the case dairy and medical examination report of the injured. From the reports, the Court finds that no one received serious injury. Though such confinement of the p. 2 employees of the company is alleged but considering the fact that the petitioners belong one village and some of them are women, this Court is inclined to direct them to surrender before the learned court below for being released on bail with stringent conditions even though not inclined to entertain their bail plea. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioners surrender before the court of learned J.M.F.C.-II, Sambalpur within a fortnight from today, it is directed that they shall be released on bail in connection with G.R. Case No.99 of 2026 arising out of Dhama P.S. Case No.19 dated 31st January, 2026 on furnishing a bail bond of Rs.15,000/- (rupees fifteen thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed proper in the facts in the circumstances of the case besides the following, such as, none of them shall be involved in any similar criminal activities in future while on bail and to furnish an undertaking at the local P.S. in that regard. 6.
