2. By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:-
“i) That the representation Annexure P4 (Colly) of the petitioner dated 16th April, 2026 and 3rd June, 2026 may kindly be ordered to be decided positively in a time bound manner. ii) That petitioner may kindly be directly ordered to be transferred with respect to clause 16.5 of the transfer policy to any of the 3 stations of his choice as per the priority 1 Whether reporters of the local papers may be allowed to see the judgment?
mentioned in paragraph 5 of the petition and in the representation.”
3. The grievance of the petitioner is that despite his having represented to the Authorities, he is not being transferred out of the tribal area. The petitioner has been appointed as a Language Teacher, earlier on a contract basis on 08.12.2021, and his services have been regularized on 24.04.2024.

Learned counsel for the petitioner submits that as the petitioner hails from the tribal area, therefore, he has to serve more than 5 years in the tribal area as per the transfer policy. He submits that the inaction on the part of the authority is not sustainable in light of the ill health of his mother.

On a query put to the learned counsel as to how many brothers and sisters the petitioner has, he though states that petitioner has a brother, but he could not assist the court as to what the brother does and where he lives. Otherwise also, a perusal of the petition demonstrates that the petitioner is praying for his transfer again to a station in a tribal area, which defies the basis on which the transfer is being sought by the petitioner. petitioner is unwell, then obviously, the transfer should have been sought to a station where good medical facilities are available.

Therefore, as this court is of the considered view that the alleged ill health of the mother is just being used as a tool by the petitioner to seek his transfer, this court does not find any merit in the present petition, and the same is dismissed. Pending applications, if any, also stand disposed of.
