By way of instant application filed under Section 5 of the Limitation Act, prayer has been made by the applicant/petitioner for condonation of delay in maintaining the accompanying petition, which is barred by limitation.
Mr. Deepak Sharma, Advocate and Mr. Rajan Kahol, learned Additional Advocate General, while appearing on behalf of the non-applicants/respondent No.1 and respondent No.2, state that they do not intend to file reply to the application and this court may pass appropriate orders.
Having carefully perused averments contained in the application, this Court is convinced and satisfied that delay in maintaining the accompanying petition is neither intentional nor willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, delay, which has been sufficiently explained, is condoned. The application is disposed of.

Notice in the aforesaid terms. Reply, if any, on or before the next date of hearing. In the meantime, substantive sentence imposed by the learned trial court shall remain suspended, subject to applicant’s depositing 40% of the compensation amount, which shall also include the amount already deposited and furnishing personal bonds in the sum of Rs. 25,000/- (rupees twenty five thousand only) with one surety of the like amount to the satisfaction of the trial Court within six weeks.
