Heard Mr. Sunil Kr. Upadhyay, learned counsel for the petitioner and learned P.P.
The petitioner apprehends his arrest in connection with Jagarnathpur P.S. Case No.01 of 2026.
It has been alleged that the driver of the Omini van had dashed against the son of the informant resulting in his death.
Submission has been advanced by learned counsel for the petitioner that it was Ali Zoheb who was the driver of the vehicle and on his confession the name of the petitioner has surfaced.
The case diary has been perused from which it appears that save and except the confessional statement of Ali Zoheb there is no other material which would indicate that the petitioner was the driver of the Omini van when it crushed the son of the informant.
Regard being had to the above, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, he is directed to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-IX, Ranchi in connection with Jagarnathpur P.S. Case No.01 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
This application stands allowed.
