2.
Learned counsel for the petitioner submits that petitioner is not pressing this writ petition on merit at this stage, however, as the petitioner has already submitted representation raising objection of erroneous mentioning of her name in the T-cadre gradation list, it is to be corrected and, therefore, petitioner prays that a direction be issued to respondent No.5/District Education Officer to take decision on her representation.
3.
Learned counsel for the State submits that though she is not having any objection to the limited prayer made by learned counsel for the petitioner, however, she submits that perusal of Annexure P-9 (at page No.35 of writ petition) would show that representation is made to Block Education Officer and Block Education Officer is not a party in the present writ petition.
4.
Learned counsel for the petitioner also submits that claim of petitioner is to be considered in appropriate manner by the District Education Officer and therefore in the facts of case, petitioner may be permitted to submit fresh representation raising all the grounds as raised in this writ petition before respondent No.5/ District Education Officer and concerned authority be directed to take decision on the representation to be submitted by petitioner at the earliest.
5. On due consideration of submission of learned counsel for the parties, looking to the nature of grievance raised, this writ petition at this stage is disposed off permitting the petitioner to submit a comprehensive representation raising all the grounds as raised in this writ petition along with relevant documents and in the event petitioner submits such representation before respondent No.5, concerned authority shall
4 / 4 consider and decide the same in accordance with law, expeditiously, preferably within a further period of 3 months from the date of receipt of representation. Sd/- Sd/- (Parth Prateem Sahu) Judge Praveen
