The present writ petition has been filed seeking setting aside of the vacation notice dated 1st July, 2026 and the consequent demolition carried out by the respondent/MCD on 30th July, 2026 of the petitioner’s property bearing no.RZ-49-F, Pankha Road, Dabri, New Delhi. 2. The petitioner had filed an appeal against the impugned vacation notice before the ATMCD. However, the said appeal has been dismissed vide order dated 29th July, 2026 holding that an appeal is not maintainable against the vacation notice. Consequently, liberty was given to the petitioner to challenge the demolition/sealing order. 3. Counsel for the petitioner submits that the petitioner has not received the demolition order. 4. The petitioner seeks and is granted two (2) weeks’ time to file an appeal before the ATMCD against the aforesaid demolition order. 6. Counsel for the petitioner submits that the petitioner is also in the process of filing a regularisation application before MCD. 7. In the event such an application is filed, the same shall be considered by MCD in accordance with law. 8. Consequently, the present writ petition is disposed of while directing that for a period of two (2) weeks from today, no coercive steps shall be taken against the property of the petitioner. 9.
