JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners seek the following reliefs: “a) Issue a writ in the nature of mandamus directing the respondents to make the services of the petitioners permanent with effect from the dates on which they have completed 10 years of service together with all consequential service benefits as also to extend the pay scale on par with similarly situated employees in the Sports Authority of India; - 8 - HC-KAR NC: 2026:KHC:14988 WP No. 15489 of 2021 Or in the alternative To issue a writ in the nature of mandamus directing the respondents to consider the representations dated 15.07.2021 as per Annexure-H, in the interest of justice and equity; and b) pass such other order or order as deemed fit and proper by this Hon’ble Court to meet the ends of justice and equity.” 2. Heard learned Senior Counsel for the petitioners and learned AGA for the respondents and perused the material on record. 3. Learned Senior Counsel for the petitioners invited my attention to the order passed by this Court in W.P.No.19904/2024 dated 26.07.2024 in relation to the similarly situated persons and submits that similar orders may also be passed in the present petition. The said order reads as under: “In this petition, petitioner seeks the following reliefs: “ a) Issue a writ in the nature of mandamus directing the respondents to regularize the services of the petitioners as coaches / Junior Coaches from the date on which the petitioners have completed 10 years of service and extend all other consequential monetary benefits to meet the ends of justice and b) Issue any other appropriate writ, order or orders or direction as this Hon’ble Court may deems - 9 - HC-KAR NC: 2026:KHC:14988 WP No. 15489 of 2021 fit to grant under the facts and circumstances of the case, in the interest of justice.” 2. Heard learned counsel for the petitioners and learned AGA for the respondents and perused the material on record. 3. On 26.07.2024, this Court passed the following order: “Sri S B Mukkannappa, the learned counsel for the petitioners, is heard on the grant of ad interim order. The petitioners' case in very brief is that they have been in service with the third respondent as Coaches/Junior Coaches for over twenty five years; that though a proposal was mooted for their regularization, the same has not followed through; that the petitioners have been reverted to consolidated pay with increments; that now the C & R Rules are framed despite objections by the petitioners without providing for regularization. As regards the urgency, Sri S B Mukkannappa submits that most of the petitioners are aged beyond fifty years and there is no possibility of them getting employed and proposals are on anvil to issue Notifications inviting applications for filling up 157 posts under the newly framed C & R Rules, and if all the posts are filled up, the petitioners will lose all opportunities despite having served for over twenty five years. Upon consideration of these submissions, this Court is of the view that the respondents, at this stage - 10 - HC-KAR NC: 2026:KHC:14988 WP No. 15489 of 2021 when pleadings are to be completed, could proceed to invite applications for filling up of the posts excluding the twenty five posts so that that the petitioners' rights are not prejudiced if they could succeed in this petition, and that if the respondents are inclined to invite applications to fill up all 157 posts, they must seek necessary permission after completion of the pleadings. It is ordered accordingly. Sri Naveen Chandrashekar, the learned Additional Government Advocate, is called upon to accept notice for the respondents. The petitioners and the respondents are at liberty to seek for early hearing once the pleadings are complete, and the respondents shall be at liberty to complete their pleadings within four weeks.” 4. Learned AGA for the respondents submits that if reasonable time is granted, the respondents would consider the claim of the petitioners for regularization and take appropriate decision / pass appropriate orders in accordance with law. 5. The said submission is placed on record. 6.
