The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to quash transfer order dated 05.01.2026, issued by the Respondent No. 1 (so far as concerned to the petitioner.). 10.2 Any other relief, which may be deemed fit by this Hon’ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner is a Doctor and is posted as Medical Officer at Community Health Centre, Nikum, 2 District – Durg (C.G.) vide order dated 05.01.2026 (Annexure P/1), he has been transferred to District Hospital, Bijapur, District – Bijapur, (C.G.). He submits that District – Bijapur is core scheduled area and according to the policy formulated by the State Government dated 03.06.2015, the employees who are more than 55 years of age, are not to be posted in the core scheduled area. In the present case, petitioner is aged about 61 years and therefore, against the order dated 05.01.2026, petitioner has already submitted representation 07.01.2026 which is pending consideration. He also submits that the petitioner till date is working on the earlier place of posting i.e. Medical Officer at Community Health Centre, Nikum, District – Durg (C.G.) and has not been relieved. Till decision is taken on the representation submitted by the petitioner, some interim protection may be granted. 3. On the other hand, learned counsel for the Respondents/State raises an objection and submits that according to the pleadings made in the writ petition and the submission of counsel for the petitioner, he has already submitted representation before the Transfer Committee and therefore, the grievance of the petitioner will be considered by the Committee in accordance with law. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner in particular, considering that the petitioner has already submitted representation against the impugned transfer order for the reasons assigned therein before the Committee constituted under the Transfer Policy, 2025, petitioner is aged about 61 years and taking into consideration the policy formulated by the State Government dated 03.06.2015, this writ petition is disposed of at this stage directing the 3 Committee constituted under the Transfer Policy to consider the representation submitted by the petitioner in an objective manner, adopting pragmatic approach, sympathetically within a period of 04 weeks from the receipt of the order. 6. Further, it is directed that, till decision is taken on the representation submitted by the petitioner, the transfer order dated 05.01.2026 (Annexure P/1) so far as it relates to the petitioner shall remain stayed. 7.
