APHC010033272026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI I.A. No.1 of 2026 in/and Writ Appeal No: 67 of 2026 Bench Sr.No:-43 [3552] Pilli Rajakumari and Others ...Appellant(s) Vs. Onum Sreenu and Others ...Respondent(s) ********** Advocate for Appellants: Mrs. M.S.V.S. Sudha Rani Advocate(s) for Respondent(s): Mr. Yarraguntla.Koteswara Rao, Standing Counsel for Zilla Praja Parishads,Mandal Praja Parishads CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 16th February 2026 P C : I.A. No.1 of 2026 has been filed seeking condonation of 1142 days delay in preferring appeal against the judgment and order, dated 18.11.2022, passed in W.P. No.13230 of 2021. 2. The applicants were respondent Nos.7 and 8 in the writ petition and suffered the judgment and order with a direction to the Gram Panchayat authorities to remove the illegal construction made by them on the water body. The order was to be executed within a period of four weeks. Even though the direction was specifically against respondent Nos.7 and 8 in the writ petition 2 HCJ & CGR, J W.A. No:67 of 2026 i.e., the appellants/applicants herein, they chose to remain silent for as long as 1142 days beyond the period prescribed for filing the writ appeal. 3. The explanation, as can be seen from the application filed before us, is that even when the counsel for the applicants had advised the applicants to file a writ appeal, yet on account of financial constraints and ill-health of the children, the appeal could not be filed. 4. The justification offered for seeking condonation of delay on account of financial constraints and ill-health of children is not supported or buttressed by any material on record. The explanation thus rendered does not persuade us to allow the application for condoning the delay as long as 1142 days. We, therefore, find no merit in the present application, which is, accordingly, dismissed. Consequently, the Writ Appeal also stands dismissed. No costs. Pending miscellaneous applications, if any, shall stand closed. DHIRAJ SINGH THAKUR, CJ CHALLA GUNARANJAN, J akn 3 HCJ & CGR, J W.A.
