Petitioner has filed this writ petition seeking following relief (s) :- BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 “10.1 That, this Hon’ble Court may kindly be pleased to set-aside of the impugned transfer order dated 08.12.2025 Annexure P-1 issued by respondent No.2. 10.2 That, this Hon’ble Court may kindly be pleased to set-aside of the reliving order dated 12.12.2025 Annexure P-8 issued by respondent No.3 and allow the petitioner to continue at present place of posting. 10.3 Any other relief or reliefs may also be granted to the petitioner which this Hon’ble Court deems fit and proper in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner is working on the post of Patwari was earlier working in the Patwari Halka No. No.3, Raghunathpur, District Balrampur – Ramanujganj was transferred to Patwari Halka No.11, Tahsil Raghunathpur vide order dated 01.08.2025 and within a short span of four months, petitioner has been again re-shifted from Tahsil Wadrafnagar to Tahsil Samari. He contended that according to transfer policy, employee who has not completed one year in the present place of posting are not to be considered for transfer. Child of the petitioner is studying in the school and if petitioner is to be shifted to another place, study of his child will also be affected and further petitioner is suffering with spinal disease. Copy of medical documents is placed on record as Annexure P-5. 3. Learned State counsel submits that earlier posting of petitioner was only temporary arrangement made by Sub-Divisional Officer by shifting the Patwaris from one Patwari Halka to another Patwari Halka within the same Tahsil, however, Annexure P-1 is an order of transfer. Petitioner can very well submit representation before the Committee constituted under the transfer policy for redressal of his grievance. However, no representation has been filed. 3 4. At this stage, learned counsel for petitioner submits that he may be permitted to submit representation and direction be issued to take decision on the representation submitted by petitioner at the earliest and some interim protection may be granted. 5. On due consideration on the submission of learned counsel for parties, this writ petition at this stage is disposed of permitting petitioner to submit representation before the Committee constituted under transfer policy and if such representation to be is submitted, the concerned Committee shall consider and take decision on the representation submitted by petitioner within further period of two weeks from the date of receipt of representation. 6. Till the representation submitted by petitioner is decided by the Committee, no coercive action shall be taken against petitioner. 7.
