------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY
-------
For the Petitioner : Mr. Sunil Singh, Advocate
For the Opp. Party : Mr. Rakesh Kr. Sinha, A.P.P
-------
02/02.06.2026 Heard Mr. Sunil Singh, learned counsel for the petitioner and learned A.P.P.
The petitioner is an accused in connection with Kolebira P.S. Case No.54 of 2011.
It has been alleged that the father of the informant was murdered by unknown persons.
Submission has been advanced by learned counsel for the petitioner that the petitioner has been implicated only on the basis of suspicion. It has been submitted that there are no eye-witnesses to the occurrence. Learned counsel adds that the petitioner is in custody since 10.04.2025 and three witnesses have been examined by the prosecution so far and all have been declared hostile by the prosecution.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
Regard being had to the paucity of evidence to connect the petitioner with the commission of the murder of the father of the informant, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Simdega in connection with Kolebira P.S. Case No.54 of 2011, subject to the condition that the petitioner shall physically remain present before the learned trial court on each and every date till the conclusion of the trial, unless prevented by sufficient cause.
