Learned counsel for the petitioner submits that after dismissal of first bail application on 27.08.2025, a charge- sheet has already been filed. He also submits that the recovered quantity in the instant case is little higher than small quantity but quite less than commercial quantity. He also submits that co-accused Dipendra Singh @ Deep @ Bhanja was granted bail by a Co-ordinate Bench on 22.07.2025. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. On basis of information SHO, P.S. Pilani, has recovered 1.961 kg ganja from possession of present applicant and registered a case under Section 8/20 of NDPS Act. Applicant is in custody since 07.04.2025. The material on record indicate that a similar nature of 3 cases under Section 8/20 of NDPS Act were registered in year, 2022, 2024 and 2025. It is also evident that present applicant-accused was released on bail on 29.03.2025 in two cases and still he was found involved in present case relating to NDPS Act. 7. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far and continuous involvement of the present [2026:RJ-JP:4226] (3 of 3) [CRLMB-862/2026] petitioner in identical nature of cases, this is not a fit case to enlarge the applicant accused on bail. 8. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage. 9. Accordingly, the instant 2nd application for bail filed under Section 483 of BNSS preferred by the applicant-accused Adrish S/o Asagar is hereby dismissed. (ASHOK KUMAR JAIN),J MR/4
