3. This petition has been filed with the following prayers:-
“i. Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to reopen/ reconduct the reverse action bearing RA No. GEM/2026/R/696768, so as to restore to the Petitioner the opportunity to submit its next bid in the competitive bidding process; ii. direction directing the Respondents to conduct a fresh Reverse Auction amongst the eligible bidders, including the Petitioner, in accordance with the applicable terms and conditions; iii. Pending the hearing and final disposal of the present Petition, direct the Respondents to maintain status quo in respect of the procurement pursuant to RA No. GEM/2026/R/696768 and restrain the Respondents from finalising the procurement, issuing the award or entering into any binding contractual arrangement pursuant thereto; iv. Direct Respondent No. 1 to preserve and produce the complete electronic records, audit trails, bid logs, server logs, system-generated records, access logs and other data pertaining to RA No. GEM/2026/R/696768, including the records relating to the Petitioner's attempted revised bid, the Internal Server Error encountered by the Petitioner and GeM Helpdesk Ticket No. 13378536; v. Pass such other and further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.”

At the outset, learned counsel for the respondent no.1 has drawn our attention to the communication dated 19.08.2026 received from the J. N. Medical College & Hospital, Aligarh Muslim University, Aligarh-U.P. for which the tender has been issued, wherein the Hospital/University has requested the respondent no.1 to extend the Reverse Auction No. GEM/2026/R/696768, in order to enable the participation of the petitioner. 5. He states that a decision has been taken by the respondent no.1 to act on the communication received from the Hospital/University and extend the time. He further states that new schedule has not been fixed as of today, the same shall be fixed and informed to all the bidders. Taking the submission on record, as stated by Mr. Puri, the petition is disposed of. This is a digitally signed order.
