3. The FIR in connection with which the petitioner was arrested on 22.09.2026 was lodged by the victim herself stating inter alia that while she was walking down the road, her gold chain was snatched by an unknown person at around 6:20 am on 16.09.2026. In the said FIR, the victim had also given the necessary particulars of the snatcher. 4. The learned counsel for the petitioner submits that during the investigation, the Police arrested the petitioner on certain admissions made by the main accused person to the effect that he sold the suspected chain to the petitioner. However, he submits that in the Forwarding Report, it is clear that the main accused person gave the gold chain to his brother-in-law, who sold it to the petitioner. He infact submits that the petitioner is not involved in the said offence and he as a genuine purchaser had purchased the article from the main accused person. 5. Mr. RJ Baruah, learned Additional Public Prosecutor, on the other hand, submits that the Forwarding Report shows that it is an organized crime and petitioner along with the main accused person and together with another person had indulged themselves in such an offence and as such, he prays for calling of the case diary. He also submits that from the seizure list sufficient incriminating materials are found against the petitioner. 6.
Upon consideration of the submissions made by the learned counsels, more so, in view of the fact that no averment is made in the Forwarding Report that the petitioner had the knowledge that the said gold chain is a stolen one, this Court enlarges the petitioner on bail on furnishing a bail bond of Rs.20,000/- with one local surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M) under the following conditions:-
