An Appeal under Section 96 read with Section XLI CPC has been filed against the Judgment and Decree dated 10.03.2026, whereby the Suit of the Plaintiff/Respondent for Possession, Permanent Injunction and Mesne Profits has been decreed. 2. The Appellant who is present in the Court along with learned Counsel undertakes to vacate the property within three months from today. The Appellant also undertakes not to create any third party rights or cause damage to the property, till the time he vacate the same. Learned counsel for the Respondent on instructions from the Respondent states that in case the property is vacated within three months, the Respondent shall forego his claim for Mesne Profits. 4. It is also agreed that in case the Appellant fails to perform his part of the Settlement and vacate the premises within three months, the Respondent shall be at liberty to seek the execution of the Decree. 5. The Undertaking be filed by both the parties within seven days. 6. In view of the Settlement, the Appeal is disposed of. However, the eviction of the property and the relief in respect of Mesne Profits shall be effected in terms of the Settlement between the parties. 7.
