The present application has been filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) for grant of regular bail in FIR No. 64/2024 under Section 302 of Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’) registered at Police Station K.N. Katju Marg, North District, Delhi. 3. Learned counsel for the petitioner submits that no grounds of arrest was communicated to the petitioner. 4. He has been in judicial custody for the last two and a half years. He further submits that the co-accused has already been granted bail by a Coordinate Bench of this Court and, therefore, he seeks bail on the ground of parity as well. The previous two bail applications were withdrawn by the petitioner, while one application was dismissed on merits by a Coordinate Bench of this Court. It is further submitted that the ground of parity had already been raised by the petitioner in the earlier application, which was dismissed by the Coordinate Bench of this Court. As regards the ground pertaining to non-communication of the grounds of arrest, learned APP submits that the said ground had also been raised in the earlier bail application. 6. This Court has already distinguished the role attributed to the petitioner from that of the co-accused. The allegations against the petitioner are serious and heinous in nature, involving an offence punishable under Section 302 of the IPC 7. Therefore, no ground for grant of bail is made out. Accordingly, the present bail application is dismissed. 8. It is clarified that the observations made herein are only for the purpose of deciding the present bail application and shall not prejudice the merits of the case. 9.
