The petitioners apprehend their arrest in connection with Complaint Case No.638 of 2017. It has been alleged that forest land was being leveled for the purpose of cultivation with a JCB Machine and when the JCB Machine was seized by the forest authorities and the driver was apprehended, the villagers had come to the place of occurrence and had freed the said driver. It has been submitted by learned counsel for the petitioners that the petitioner no.1 is the owner of the JCB machine while the petitioner no.2 is the driver. It has been submitted that none of the petitioners have any criminal antecedents. Learned Spl.P.P has submitted that the petitioners were absconding for almost nine years. It appears that apart from the petitioners absconding, the other factor reveals that the petitioner no.2 was freed with the help of the petitioner no.1 and the villagers from the lawful custody of the forest officials. Regard being had to the aforesaid facts, I am not inclined to extend the privilege of anticipatory bail to the petitioners. The same is hereby rejected. (Rongon Mukhopadhyay, J.)
