THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD ORAL ORDER 1. In this writ petition, the petitioners have sought for the following reliefs: a. Issue a Writ of Mandamus or any other order or direction, directing the respondents 1 to 3 to take suitable action to transfer the petitioners to any other Private Aided ITI Institutions or Government ITI Institutions where vacancies in the cadre of Junior Training Officer (JTOs), FDA, SDA, Attender and Group D post are available with a further direction to extend all - 6 - HC-KAR NC: 2026:KHC:8604 WP No. 56092 of 2018 consequential service benefits to them, in the interest of justice. b. Issue a Writ of Mandamus or any other writ; order or direction, directing respondents 1 to 3 to take suitable action to recover the salary and emoluments payable to the petitioners from the month of March 2015 from the 5th & 6th respondents and pay the same to the petitioners herein, in the interest of justice and equity. C. Issue a Writ of Mandamus or any other writ, order or direction, directing the 6th respondent to return/ handover to the Petitioners all the original certificates/ testimonials/marks cards collected from the Petitioners at the time of their initial appointment, in the interest of justice and equity. d. Pass any other appropriate suitable orders or directions as this Hon'ble Court deems fit and necessary in the interest of justice and equity. 2. The case of the petitioners is that they were working as Junior Training Officers in respondent No.7, Institution. Their appointments were admitted to grant-in-aid. Since the respondent No.7 was closed, the petitioners sought for transferring them to other aided institution. 3. The learned AGA submits that in view of new Rules framed by the State Government amending the Grant-in- - 7 - HC-KAR NC: 2026:KHC:8604 WP No. 56092 of 2018 aid ITI Rules, 2025, the case of the petitioners will be considered in accordance with law, within four weeks. 4. In view of the above, without expressing any opinion on the merits of the case, the writ petition is disposed of. 5. The respondent No.2 is directed to consider the representations of the petitioners in accordance with law and pass appropriate orders within four weeks from the date of receipt of certified copy of this order. 6.
