1. Having heard learned counsel for the parties and perused the material on record, we are of the considered opinion that there is no error, apparent on the face of record, in the order which is sought to be recalled by the exercise of review jurisdiction.
2. Admittedly, the bank loan obtained by review petitioner (borrower) has been squared by the non-applicants herein (the guarantor) and they being a co-owner of the mortgaged property with the review petitioner, are entitled to the restoration of possession.
3. We, however, make it clear that the restoration of possession by the bank in favour of the non-applicants shall not prejudice the rights of either of the parties who are agitating their before the Civil Court.
