JUSTICE S SUNIL DUTT YADAV - 3 - HC-KAR NC: 2026:KHC:14909 WP No. 7940 of 2026 ORAL ORDER The petitioners have sought for setting aside of the General Award dated 31.12.2013 insofar as it pertains to the lands of petitioner No.1 ie., Sy.Nos.203/4 and 203/5 and the land of petitioner No.3 in Sy.No.212/4 situated at * Bannikuppe Village, Harohalli Hobli, Harohalli/Kanakapura Taluk, Ramanagara District (formerly Bangalore South District)" and have also sought a direction to pass orders in terms of Section 29(2) of the Karnataka Industrial Areas Development Act, 1966 by way of agreement. 2. The petitioners have sought for similar relief as regards the land of petitioner No.2 in Sy.No.234/P7 situated in the same village. 3. Learned counsel for the respondent - Karnataka Industrial Area Development Board (KIADB) submits that the petition itself could be disposed of while setting aside the general award insofar as the petitioners are concerned and the respondent - Special Land Acquisition Officer, * Corrected vide Court order dated 27.04.2026. - 4 - HC-KAR NC: 2026:KHC:14909 WP No. 7940 of 2026 KIADB would consider the request of the petitioners and pass a consent award as per law. 4. In light of the said stand and taking note of the directions passed in W.P.No.15026/2021, the petition is disposed of as follows: (i) The impugned general award at Annexure-F and G insofar as the petitioners' land is concerned, is set aside. (ii) Respondent No.3 is directed to consider the claim of the petitioners for passing of consent award and pass a consent award in terms of Section 29(2) of the Karnataka Industrial Areas Development Act, 1966, within a period of four months from the date of receipt of copy of this order. 5. It is made clear that, in the event of there being any dispute with regard to entitlement and apportionment - 5 - HC-KAR NC: 2026:KHC:14909 WP No. 7940 of 2026 of the award amount, the general award at Annexure-F and G would stand revived. 6. Liberty is reserved to the Special Land Acquisition Officer, KIADB to withdraw the amount, if deposited before the Civil Court pursuant to the general award. 7.
