HON'BLE GARIMA PRASHAD, J.
1. Heard Ms. Vaishnavi Tripathi holding brief of Sri Nagendra Kumar Tripathi, learned counsel for the petitioner and Ms. Shruti Malviya, learned State Law Officer for the State-respondents.
2. This petition is filed by son of maulvi of the mosque seeking a prayer for a direction to the respondent no. 2 to permit the petitioner to install loud speaker over and above the mosque so that it may be used during azan.
3. A preliminary objection has been raised by the State Law Officer that on behalf of son of the maulvi, the writ petition is not maintainable and it is the maulvi or the management of mosque which could come forward for installing loud speaker moreover in the circumstances there is no restrained order for performing the azan.
4. We find substance in the objection so raised by learned State Law Officer and hence we decline to grant indulgence in the matter. However, liberty rests to the maulvi concerned to approach this Court, if so advised.
