The petitioner has filed the present petition, impugning an endorsement dated 04.06.2024 whereby the petitioner's representation for grant of mining licence in land falling in Sy.No.17 of Dyapenahalli, Urdegere Hobli, Tumkur taluk, was rejected. 2. The petitioner states that several persons who are similarly placed as the petitioner had filed applications for grant of mining leases in Tumkur district on around 28.03.1996. The petitioner states that he belongs to the SC category, and that he and his father had filed an application for grant of mining lease on 29.07.2005. Thereafter, on 16.05.2015, the petitioner had also filed the Income certificate and caste certificate as prescribed. The - 4 - HC-KAR NC: 2026:KHC:9455-DB WP No. 16596 of 2025 petitioner states that around 18.06.2023, he addressed a letter to the concerned Jurisdictional Tahsildar for grant of land to an extent of 5 acres located in Sy.No.17 of Dyapenahalli, Urdegere Hobli, Tumkur taluk, for the purpose of carrying on mining activities. The petitioner also pursued the said request with the concerned authorities for grant of the said application. However, the same was rejected by impugned endorsement dated 04.06.2024. 3. A plain reading of the said endorsement indicates that the concerned authority had noted that there were 32.05 guntas of gomala land falling in Survey No.17 and a part of the said land has already been granted to the farmers for the purpose of farming. The remaining land was needed for grazing of livestock, sheeps and goats. 4. A spot inspection (mahazar) was conducted and the Inspector has furnished a report that stone quarry should not be permitted on the land in question. 5. Clearly the petitioner cannot claim any right to insist on being granted mining rights in respect of land, which the authorities have found suitable for other purposes.
