JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question the proceedings in C.C.No.452/2024, pending before the Principal Civil Judge and JMFC, Kanakapura, for the offences under Sections 323, 326, 504, 506 r/w. 34 of the IPC. 2. Heard Sri Nagendra B., learned counsel appearing for the petitioners, Sri B.N.Jagadeesha, learned Additional State Public Prosecutor appearing for respondent No.1 and Sri Sandeepa M., learned counsel appearing for respondent No.2. - 3 - HC-KAR NC: 2026:KHC:12905 CRL.P No. 2969 of 2026 3. Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have resolved the dispute among themselves. In this regard, the parties have filed an application under Section 528 r/w. 359 of the BNSS, 2023 along with a joint affidavit before this Court. 4. The joint affidavit reads as follows: “2. We submits that we have filed this petition for quashing the entire proceedings, in CC- 452/2024 (Cr,No- 96/2024) By the Harohalli Police, for the offences P/u sec- 323, 326, 504, 506, R/W 34 of IPC, on the file of Prl, Civil Judge at Kanakapura, 3. we submits that the both are ready to settled the matter with the permission off this Hon'ble Court, both are friends we are residing in the same village therefore we are amicably, settled the issue in order to avoid the repetition kindly taken my petition averments as a fact of the case. 4. I submits that we have a good case on merits and entire proceedings will not be quashed I would grate hardship and will be put the street, if the petition is allowed there is no hardship prejudice to the other side. WHEREFORE, I most humbly pray that this Hon’ble court may kindly be pleased to allow the accompanying application and quash the entire proceedings on the basis of compromise, in the interest of justice.” In the light of the afore-quoted joint affidavit of the parties, though the offences alleged are Sections 504 and 506 - 4 - HC-KAR NC: 2026:KHC:12905 CRL.P No. 2969 of 2026 of the IPC, which are non-cognizable offences, I deem it appropriate to terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is allowed. (b) The proceedings in C.C.No.452/2024 (arising out of Crime No.96/2024) pending before the Principal Civil Judge and JMFC, Kanakapura, qua the petitioners, stand quashed.
