02/02.06.2026 Heard Mr. Md. Zaid Ahmed, learned counsel for the petitioners and learned A.P.P.
The petitioners apprehend their arrest in connection with Barwadda P.S. Case No.37 of 2026. It has been alleged that while the informant along with her family members were demolishing their old house for constructing a new house, the accused persons had arrived and committed assault upon them which had led to some of the members of the informant party suffering injuries. Submission has been advanced by learned counsel for the petitioners that the main allegation of assault has been attributed to Binod Mahato, Samu Mahato and Ranjit Mahato. It has been submitted that in fact the construction was being made on the land of the petitioners and it was the informant parties who were the aggressors for which a case was already instituted as Barwadda P.S. Case No.36 of 2026 two days prior to the case instituted by the informant. Learned counsel submits that even otherwise the allegations are general and omnibus in nature so far as the petitioners are concerned. 2
Learned A.P.P has opposed the prayer for anticipatory bail of the petitioners. Regard being had to the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, they are directed to surrender before the learned court below within a period of four weeks and on their surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Barwadda P.S. Case No.37 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. This application stands allowed.
