Heard Mr. A.K Kashyap, learned senior counsel for the petitioner and learned Spl. PP. 2. The petitioner is an accused in connection with Pathargama P.S Case No. 13 of 2026. 3. It has been alleged that the informant was fired upon by some unknown persons. It has further been alleged that marital disputes were going on between the informant and her husband. So far as the petitioner is concerned, he is the brother-in-law of the informant. One of the co-accused namely Md. Arif has been granted bail in B.A. No. 3142 of 2026. 4. Learned Spl.P.P. has admitted that the face of the assailants were covered and hence it was an impossibility to identify the assailants. Learned counsel further submits that so far as, Md. Arif is concerned his case was on different footing. 5. Learned Spl. PP has failed to state as to whether the petitioner was responsible for firing at the informant as it had been specifically stated by her that the assailants had covered their faces, thus making identification an impossibility. 6. Regard being had to the above, the petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Divisional Judicial Magistrate, Godda, in connection with Pathargama P.S Case No. 13 of 2026. 7.
