JUSTICE SANDEEP KUMAR ORAL ORDER 6 14-05-2026 Heard learned counsel for the parties. 2. This application for grant of regular bail arises out of Baikunthpur P.S. Case No.88 of 2025 registered for the offence punishable under sections 137(2), 87, 126(2), 115(2), 352, 351(3) and 3(5) of the B.N.S. but the charge-sheet has been submitted under sections 137, 87 and 61(1) of the B.N.S. and under sections 4 and 6 of the POCSO Act. 3. The petitioner is accused of kidnapping the minor daughter of the informant for the purpose of marriage. 4. The petitioner is in custody since 13.03.2025. He is accused three more criminal cases. From the statement of the victim girl recorded under section 183 of the B.N.SS, it appears that she had eloped with the petitioner and had gone to Haryana. The victim girl has also stated that she had also got married to the petitioner. 6. Considering the statement of the victim girl recorded under section 183 of the B.N.S.S, this application is allowed. 7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, VI-cum- Special Judge, POCSO, Gopalganj / concerned Court below, in connection with Baikunthpur P.S. Case No.88 of 2025. 8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case. pawan/- (Sandeep Kumar, J) U T
