JUSTICE ALOK KUMAR SINHA ORAL ORDER 2 13-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Lakhaura P.S. Case No. 242 of 2025, registered for the offence punishable under Sections 318(4), 338, 336(3), 340(2), 308(2), 352, 3(5) of the B.N.S., 2023. 3. The case of the prosecution, in short, is that the informant alleged that several parcels of land belonging to his family, recorded under different khata and khasra numbers and registered in the names of his father, grandfather, brother and himself between the years 1960 to 1968, were illegally sold by the accused persons through forged and fabricated documents. It Patna High Court CR. MISC. No.31938 of 2026(2) dt.13-05-2026 2/4 is alleged that co-accused Sachin Kumar sold 3 kattha 10 dhura of land to Rajeshwar Rai on 18-01-2025 and petitioner Manoj Tiwari sold 14 kattha of land to Asha Devi and Rambha Devi on 01-07-2025. The informant further alleged that all the accused persons, namely Rajeshwar Rai, Brajkishore Rai, Anshu Kumar, Gama Kumar, Rahul Kumar, Suraj Kumar, Dheeraj Kumar, Dashrath Kumar, Sachin Kumar and Manoj Tiwari, entered into a criminal conspiracy, prepared forged documents, forged valuable security and manipulated the identity of witnesses for execution of the sale deeds in respect of the disputed land at the Registry Office, Motihari. It is also alleged that when the informant protested, the accused persons abused him, demanded extortion of Rs. 12 lakhs and threatened to kill him if he visited the land without making payment. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He further submits that he has falsely been implicated in the present case due to personal grudge and land dispute. He further submits that the petitioner and the informant are agnates and only to harass the petitioner, the present case has been lodged with false allegations. The petitioner has no criminal antecedent. 5. Learned A.P.P. for the State opposes the prayer of Patna High Court CR. MISC. No.31938 of 2026(2) dt.13-05-2026 3/4 anticipatory bail. 6. The informant and the petitioner are agnates and the dispute relates to land. In this regard, a civil dispute is also pending between the parties bearing Title Suit No. 125 of 2024 pending before Sub-Judge I, Motihari, East Champaran. The petitioner has also clean antecedent. Under these circumstances, this Court is inclined to grant privilege of anticipatory bail to the petitioner. 7. Let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Motihari, East Champaran in connection with Lakhaura P.S. Case No. 242 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and subject to the further condition that:- (i) the petitioner shall co-operate in the investigation/trial. (ii) the learned Court would, however, verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the Court Patna High Court CR. MISC. No.31938 of 2026(2) dt.13-05-2026 4/4 below shall take step for cancellation of bail bond of the petitioner.
