ANSHUMAN ORAL ORDER 3 07-05-2026 Heard Learned Counsel for the petitioners and Learned APP for the State. 2. The petitioners are apprehending arrest in connection with Mansi P.S. Case No.244 of 2025 lodged on 22.10.2025, for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2), 351(3) and 3(5) of the B.N.S., 2023. Patna High Court CR. MISC. As per the prosecution, FIR has been lodged against 8 named accused persons (the present petitioners) against whom there is allegation that accused persons were lightening fire crackers in front of informant’s house. Upon oppose, they came at the house of the informant and assaulted the informant and his family members due to which injury sustained. 4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He further submits that the petitioner and informant, both are resident of same village and they are well-known to each other. He submits that for the same date and place of occurrence, there is case and counter-case lodged from both the sides.
He further submits that there is no specific allegation against the petitioners rather general and omnibus allegation made against them. 5. Counsel submits that the criminal antecedent of the petitioners is clean. He further submits that the date of occurrence is 18.10.2025 and petitioners’ side lodged case on 19.10.2025, but the present case has been lodged on 22.10.2025 i.e., after lapse of 4 days. He further submits that the informant’s side has lodged the present case only with a view to save his skin. 6. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.20269 of 2026(3) dt.07-05-2026 3/3 bail of the petitioners and submits that there are case and counter-case between the parties and petitioner’s side has filed the case prior to informant’s side. 7. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of CJM, Khagaria, in connection with Mansi P.S.
