1. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.208/2016 dated 09.03.2016 registered at PS.: Alipur under Sections 323/341/354B/509/34 of the Indian Penal Code,1860 (IPC) and all proceedings emanating therefrom as the petitioners and respondent nos.2 to 4 have mutually settled all their disputes vide fresh Settlement Deed dated 13.04.2026. 2. Issue notice to respondent nos.2 to 4. Learned counsel for the respondent nos.2 to 4 accepts notice and submits that the respondent nos.2 to 4 have no objection if the present petition is allowed. 3. Status Report, handed over by learned APP, is taken on record. Based thereon, learned APP for the State submits that although the wife of petitioner no.1 had lodged an FIR being FIR no. 211/2016 under Sections 323/354/354(B)/506/509/451/34 of the IPC at PS.: Alipur against respondent nos.2 to 4, however, since the learned Trial Court had acquitted the accused persons therein, he has no objection if present FIR is quashed. 4. This Court has further had the occasion of interacting with the petitioners as well as the respondent nos.2 to 4, who all are present in Court.
They affirm the terms of the aforesaid Settlement Deed dated 13.04.2026, wherein it is recorded that the petitioners have paid the respondent nos.2 to 4 a total sum of Rs.2,50,000/- as full and final settlement of all their present, past and future claims and as such, the parties have agreed to put a quietus to their disputes. Respondent nos.2 to 4 hence submit that they do not wish to continue with the aforesaid FIR against the petitioners. 5. The petitioners and the respondent nos.2 to 4, present in Court, as well as their credentials, as on record, have been duly identified by the IO. 6. As noted above, a settlement based on mutual terms between the petitioners and the respondent nos.2 to 4 is the basis of filing the present petition, which is accompanied by their respective affidavit(s) qua the said effect. In view thereof, the present is a fit case for quashing the aforesaid FIR. Accordingly, as also following the law laid down by the Hon’ble This is a digitally signed order. Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr.: (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr.: (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr.: (2014) 6 SCC 466, and also since there is nothing left to corroborate and prove the case of the prosecution, continuation of the present FIR will be an exercise in futility. 7. Accordingly, the present petition is allowed FIR No.208/2016 dated 09.03.2016 registered at PS.: Alipur under Sections 323/341/354B/509/34 of the IPC and all proceedings emanating therefrom are hereby quashed. 8.
