Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to produce all the relevant records relating to case of the petitioner before this Hon'ble Court for its kind perusal. PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 10.2 That, this Hon'ble Court may kindly be pleased to permit the petitioner to prefer representation before the Respondent No. 2 and 3 and also direct the Respondent No. 2 and 3 to decide the representation of the petitioner for getting out of turn promotion to the petitioner on the post of head constable and also giving seniority and other consequential benefits to the petitioner from dated 29.05.2025 on which date the similarly situated persons have been given out of turn promotion and other benefits on next higher post. 10.3 That this Hon'ble Court may further be pleased to direct respondents to give suitable compensation to the petitioners for the mental trauma and agony, harassment and hardships suffered by them as also cost of the litigation.” 2. Learned counsel for petitioner submits that petitioner was a member of naxalite operation dated 23.09.2024 and according to the policy of the State Government, petitioner became eligible and entitled for out of turn promotion. He contended that after the naxalite operation on 26.10.2024 Respondent No. 5 vide letter to Respondent No. 4 had recommended name of petitioner and another S.I. Bhikam Sahu for giving out of turn promotion. When no action was taken, petitioner submitted representation before Respondents No.4, however, til date, no decision has been taken on the said representation. Therefore, direction be issued to Respondent No. 4 to take decision on the representation submitted by petitioner at the earliest within specific time frame. 3. Learned State counsel submits that as the petitioner is not pressing this writ petition on merits and only seeking direction to Respondent No. 4 to take decision on the representation submitted by petitioner, he is having no objection. However, he also submits that appropriate authority will be Respondents No. 2 & 3, however, no document is placed on record to show that petitioner has submitted any representation before the said authority. 3 / 3 4. At this stage, learned counsel for petitioner submits that petitioner may be permitted to submit fresh representation before Respondents No. 2 to 4 and direction be issued to the said authority to take decision on the said representation to be submitted by petitioner within specific time frame. 5. On due consideration of the submission made by leaned counsel for the respective parties, without entering into merits of writ petition, this writ petition is disposed of permitting the petitioner to submit a fresh representation before Respondents No. 2 to 4. In the event, petitioner submits such representation, Respondents No. 2 to 4 shall take decision on the representation submitted by petitioner in accordance with law, expeditiously preferably within a further period of 08 weeks from the date of receipt of representation. 6.
