The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking quashing of FIR No. 81/2025, registered at Police Station Safdarjung Enclave, New Delhi, under Sections 115(2)/126(2)/351(2)/79/74 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties. 3. The petitioner and Respondent No.2 who is present before this Court and have been duly identified by the Investigating Officer. 6. Briefly stated, the dispute arose on 06.02.2025 when the petitioner and Respondent No.2 were walking their respective pet dogs, which led to an altercation between them. Consequent thereto, the present FIR came to be registered at the instance of Respondent No.2. It is submitted that a cross FIR, being FIR No. 82/2025, was also registered at the instance of the petitioner's wife against Respondent No.2 and others. During the pendency of the proceedings, the parties amicably resolved all their disputes and executed a Settlement/Compromise Deed. Pursuant to the settlement, the proceedings arising out of the cross FIR were withdrawn and the parties have decided to put an end to all disputes. 7. On a query put by this Court, Respondent No.2, who has been duly identified by the Investigating Officer, states that she has entered into the settlement of her own free will, without any force, coercion or undue influence. She further states that she has no surviving grievance against the petitioner and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. 8. In view of the amicable settlement arrived at between the parties and the statement made by Respondent No.2, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 9. Accordingly, FIR No. 81/2025, registered at Police Station Safdarjung This is a digitally signed order.
